Detention of the Transcarpathian customs of cars with wood – illegally: Another forestry won the court

Khmelnytsky District Administrative Court acknowledged the illegal omission of Transcarpathian Customs office for the delay of eight railway carriages with the fuel-firewood of the state enterprise “Shepettivske forestry”.

This is the second won by the Court concerning the illegal detention of cars from the timber in Transcarpathia. The first decision was taken on the lawsuit of SE «Slavuta forestry», which was acknowledged by illegal detention of the Zakarpattia customs of the Dfs four carriages of this forestry.

Note that such illegal actions of the Transcarpathian customs was done, including, on the basis of order of the Chairman of Zakarpattia Oblast State administration from 13.05.2016 R. № 236 banning the export of fuel into the Transcarpathian region with a length greater than 1 meter.

However, the court took into account the fact that the specified order, according to another order from 18.08.2016, № 400, recognized as a lost validity.

It should be noted that the Transcarpathian customs of the DFS began to produce a weighing wood to determine the inconsistency of the actual weight of the product indicated in the shipping documents.

However, the weighing occurred with violations and measured in tons. As you know, in accordance with the standards, shipment of fuel wood is carried out in dense cubic meters, as indicated in the cargo customs declarations.

It is necessary to take into account and the fact that the wood at the start of weighing more than 60 days was in the semi-unloaded cars at average temperature of air +25 º C under the open air, as a result of which the wood was dried, and its weight decreased.

Thus, the claims regarding the recognition of illegal inaction of Transcarpathian customs Dfs were satisfied.

Note that at present in different regions of Ukraine there are courts concerning claims from other forestry to the illegality of detention in May this year wagons with wood.
