Another decision of the court: The acts of the Transcarpathian customs are deemed unlawful

The Lviv district Administrative Court acknowledged the wrongful omission of the Transcarpathian Customs office, which detained 27 carriages of timber from Lviv region in May this year.

The court also ordered the Zakarpattia Customs to complete customs formalities concerning the passing of these wagons through the customs border of Ukraine.

The Court considered a number of facts concerning violation of legislation by the Transcarpathian customs. In particular, such unlawful actions were done on the basis of order of the Chairman of Transcarpathian Regional State Administration from 13.05.2016 R. № 236 banning the export of fuel into the Transcarpathian region with a length greater than 1 meter. However, in August, R. Another order (from 18.08.2016 р. № 400) The chairman of the Transcarpathian Regional State administration abolished this prohibition.

Note that nine state forestry enterprises of Lviv region are one of the first to have applied administrative claims to the court on Transcarpathian Customs DFS in connection with the stop of carriages with timber at the points of crossing of the state border in Transcarpathia.

In particular, adminclaims were filed by state enterprises “Samosyanske forestry”, “Brodivske forestry”, “Buzke forestry”, “Bibrske forestry”, “Turkivska Forestry,” Drohobych Forestry, “Skolivske Forestry”, “housebreaking forestry”. The State enterprise “Slavske Forestry” appealed to the court.

We emphasize that the plaintiffs to the Court are forestry as separate business enterprises. The state agency, as well as other bodies of state power and local self-government, is forbidden to interfere with their economic relations.

Recall that recently Khmelnytsky District Administrative Court acknowledged the illegal omission of the Transcarpathian Customs office for the delay of eight railway carriages with the fuel-wood of the State enterprise “Shepettivske forestry” and Four wagons of SE «Slavuta forestry».
